Early Termination of Probation Process in Texas 

If steps are taken correctly and all of your bases are covered, the process of requesting an early termination of probation is relatively straightforward. After consulting with your attorney and verifying whether you are in fact eligible for early termination, the next step is to talk with your probation officer about your plans. At this point you need to make sure that you have satisfied all of your specific requirements for the terms of your probation. This will include completing at least 33 percent or 2 years of your probation time, whichever happens to come first.

After this, you will now be required to file a motion for early termination of probation. This motion will be used to modify the terms of your probation and will include your name, case number and division of your underlying offense. You will file this with the Clerk’s office, along with sending a copy to the State Attorney’s Office and your probation officer.

Following the filing, you can then contact the relevant judge’s judicial assistant to find out the date of your hearing. While preparing for the hearing, you can work with your attorney to decide what will be said on your behalf. Having an attorney makes the actual hearing much less of a burden on you because they will likely be the one speaking.

At the hearing, the judge will determine whether to grant your motion or to deny it. Some of the most important factors that weigh on the judge’s decision are:
